Legislative Happenings

UPCOMING SESSION

The NC General Assembly will reconvene on February 16, 2012. The NC Senate may consider matters related to redistricting, bills vetoed by Governor Perdue, election laws and adjournment resolutions. Interested citizens may listen online to upcoming session and committee meetings through the NC General Assembly website.

The NC General Assembly will convene for the regular short session on May 16.

NEW COMMITTEE APPOINTMENT

This January Senate Majority Leader Phil Berger appointed me as Co-Chairman of the Appropriations Subcommittee on General Government and as Vice Chairman of the State and Local Government Committee.

I am humbled to receive these recent appointments of increased leadership and responsibility. State and Local Government very much compliments my past work as a Union County Commissioner and the issues we face locally.

I hope that with General Government we can further improve on the administration of North Carolina Government – that the work performed flows both seamlessly and cost-effectively.

TEACHER PAYMENT SCHEDULES

I have received numerous emails and letters from teachers and parents regarding teacher payment schedule changes for August 2012. Their concerns are valid and we know of the time-sensitive nature of this issue. We have legislation drafted for the upcoming short session that will resolve these concerns well before any August financial impact would occur. I have conveyed my concerns over this issue to both the House and Senate Leadership.

I always welcome the opportunity to meet personally with the teachers, staff and others at schools in the district. Let me know if any opportunity presents itself.

GOVERNOR PERDUE’S LATEST $750 MILLION TAX INCREASE PROPOSAL

In mid-January Governor Perdue proposed once again imposing another regressive sales tax hike on North Carolina families. This proposal comes just a few weeks after her own education agency released a report showing more than $4,000 state-funded education positions were added over the past year.

Before Governor Perdue criticizes Senate Republicans for objecting to increased sales taxes on North Carolina families, she ought to garner the support of Democrat Senators. Republican Senator Tom Apodaca proposed an amendment to the state budget this past session to retain the temporary sales tax as proposed by Governor Perdue. We gave them the opportunity to support Governor Perdue’s proposal. All but 3 Democrat Senators (nearly 85%) voted against this proposal.

Pages serve one week during the legislative session. Interested students should visit the North Carolina Senate Page Program link below or contact my Legislative Assistant, Joey Stansbury, at 919-733-7659 or via email at tuckertla@ncleg.net.

All Senate members greatly appreciate the invaluable assistance pages provide us in committee meetings and on the Senate floor.

Richard Johnson for N.C. House District 55
Proven Conservative Leadership
Date: January 13, 2012 Contact: Richard Johnson (704) 694-8736

Nchouse55photo

Wadesboro—Today, January 13, 2012, Richard Johnson formally announced his candidacy for North Carolina State House. Mr. Johnson, of Wadesboro, is running for the Republican nomination in district 55. Mr. Johnson stated, “After careful prayer and meaningful discussions with my family and friends, it has become clear that the time is right to run for this office. As a husband, father of four, and grandfather of thirteen, I have become more alarmed than ever that our government is eroding the freedoms that made our nation and our state great. I have lived in this district my entire life and my family still lives here. It is time to restore our conservative values.”

“The newly redrawn district which includes all of Anson County and more of Union County has never had true conservative representation. As a former farmer and current small business owner, our state government has continually eroded the freedom business owners need to grow, create jobs and provide for our families and communities,” Johnson added.

Mr. Johnson laid out four key issues that he will be focusing on this election cycle which include:
  1. Jobs. Our state needs to realize that government doesn’t create jobs. We must work to reduce the burdensome regulations placed on our businesses.
  2. Reduce wasteful spending and reduce taxes. Democrats have controlled this state for over 100 years. Working with the new Republican majority to accomplish this takes time and business owners are needed more than ever to help make this happen.
  3. Education. With so many men and women out of work, it’s time to re-think what we do with our education. We need to ensure that our high schools and community colleges are equipped to teach valuable vocational education needed to restore our state economy.
  4. Conservative and traditional values. As a pro-life, pro-marriage conservative and also as a proud member of the NRA and supporter of the 2nd Amendment, it’s time that the people of this district had a representative that valued these sacred institutions.
“Over the next few weeks I will announce my campaign structure and report on my campaign finances,” Johnson stated. “I have worked hard to secure key endorsements from both counties and have put together a solid campaign finance team to help me communicate this message to my fellow conservative voters. I look forward to listening and learning more from the residents of District 55 throughout this campaign.”

Mr. Johnson is a resident of Wadesboro and owns Johnson Insurance Management. He is a member of First Baptist Church of Wadesboro where he serves as Deacon. He also is Presidentof Pee Dee Electric, a North Carolina Rural Electric Cooperative, as well as a board member of the NC Electric Membership Corporation. He has served on many committees and was a former school board member of Anson County. For more information about Mr. Johnson please visit www.richardjohnsonnchouse.com.

Non-partisan training session sponsored by NC Electric Co-op

Inexperienced candidates often undercut their own efforts because they do not understand the basics of campaigns. The public, and your campaign resources, are better served by candidates who have a good message and have an idea of how to communicate their messages to the voters.  To help candidates run better, more knowledgeable campaigns, North Carolina’s electric cooperatives in conjunction with the North Carolina Credit Union League will again sponsor three non-partisan Campaign Academies in early February.

Electric cooperatives and credit unions across the country have helped hundreds of candidates at similar seminars. Past participants include candidates for Congress, the NC General Assembly, Sheriff, County Commissioner, Register of Deeds, Clerk of Court, and numerous volunteers to campaigns.

The Campaign Academy is open to candidates new to the election process, incumbents who want a refresher, and other party/campaign officials or volunteers. During the seminar, taught by professionals with campaign experience, potential candidates will learn the basic set-up of a campaign and the financial commitment required. The training comes at an affordable cost of $30 for participants.

Robinson for Congress Conservative Film Festival Premieres Sat., Dec. 3, 2011

Concord, NC – The Vernon Robinson for Congress campaign announced today that it will host a Conservative Film Festival on Saturday, December 3.  The location for the event is the Hilton Garden Inn, convenient to I-85, exit 49 off Concord Mills Boulevard.  Two important, patriotic documentaries will be screened free for the public.  The keynote event, Agenda: Grinding America Down, will screen at 6 PM, to be followed by Q&A with the film’s director, special guest Curtis Bowers.  A private reception for filmmaker Curtis Bowers takes place at 5 PM.

A second political documentary will screen earlier in the day.  The announcement of this title is forthcoming.  Concessions will be available for purchase.  Parking and admission are free.

Vernon Robinson, conservative candidate for Congress NC-8, said, “These films support our strong message of limited government and succinctly and powerfully express the battle being waged for the soul of America.  Agenda has been embraced by the Tea Party movement and shows the direct cultural and political links tying Obama to the socialist philosophy currently crippling America.

Filmmaker and former Idaho State House Representative Curtis Bowers has endorsed Vernon Robinson in his Congressional race and said, “Vernon Robinson stands for the conservative principles that I champion in my film.  He has the fighting spirit, moral backbone, integrity, and experience needed to combat the left-wing agenda that is destroying America before our very eyes.”

Vernon Robinson will also be in attendance and will participate in introductions and Q&A for each program.  For more information, go to http://www.robinsonforcongress.com.

North Carolina is among the nation's worst in jobs

North Carolina has 290,200 fewer jobs than it did four years ago, before the Great Recession began.
The Tar Heel State is among eight states that have lost at least a quarter-million jobs since September 2007. The others are California (down 1.09 million jobs), Florida (down 733,700), Georgia (down 346,600), Michigan (down 329,900), Ohio (down 321,600), Illinois (down 317,300) and Arizona (down 264,000).
The recession officially began in December 2007.
North Carolina’s losses amount to nearly 7 percent of the state’s job total of four years ago, according to an On Numbers analysis of the latest employment data from the U.S. Bureau of Labor Statistics .
Nationwide, Nevada has seen the biggest percentage drop in its employment total, losing nearly 13 percent of its jobs since September 2007.
As previously reported, North Carolina’s unemployment rate edged upward to 10.5 percent in September from 10.4 percent in August, according to the N.C. Employment Security Commission. A year earlier, the statewide jobless rate was 9.1 percent. The N.C. economy gained a net 28,400 jobs in the private sector last month, but the public sector lost a net of 18,700 jobs, the ESC says.

Naked tyranny: Paul Revere’s view of Britain’s determination to cram a tea tax down Bostonians’ throats by military force after the 1773 Boston Tea Party

A U.S. Supreme Court justice recounted over cocktails a while ago his travails with his hometown zoning board. He wanted to build an addition onto his house, containing what the plans described as a home office, but he met truculent and lengthy resistance. This is a residential area, a zoning official blustered—no businesses allowed. The judge mildly explained that he would not be running a business from the new room; he would be using it as a study. Well, challenged the suspicious official, what business are you in? I work for the government, the justice replied. Okay, the official finally conceded—grudgingly, as if conferring an immense and special discretionary favor; we’ll let it go by this time. But, he snapped in conclusion, don’t ever expletive-deleted with us again.

As of late, the Left has derided the General Assembly for passing legislation that would put a defense of marriage amendment on the ballot in May instead of focusing on jobs.  They seem to have already forgotten the past session where Republicans passed job creating bills while Democrats opposed and vetoed them (We’re looking at you, Overridden Governor Perdue).  In fact, a report issued by the NC Free Enterprise Foundation found the current Republican controlled General Assembly significantly more pro-business than its predecessor—a fact that even the N&O admits.

According to the report, Republicans held the highest positions, such as President Pro Tempore Phil Berger and Speaker Thom Tillis.  Both leaders scored a 96% on a pro-business evaluation.  Democrats ranked markedly lower with the lowest  being Rep. Pricey Harrison with an 8.2% and Sen. Ellie Kinnaird at 16.4%.

Republicans entered the General Assembly with the intent of creating jobs but did not want to (due to balanced budget constraints) enact a miniature porkulus stimulus program like Obama’s.  Instead of focusing on crony capitalism and paying for pet projects—like Obama’s Solyndra—Republicans decided to forgo Keynesian economics for basic laissez faire principles.  In order to do so, they passed several pieces of legislation designed to reduce burdens on businesses including:

    • Capping non-economic damages in medical malpractice lawsuits
    • Clarifying environmental regulations
    • Reducing regulatory burdens on businesses

By passing these bills, Republicans decreased costs and risks incurred by businesses, increased their ability to produce goods and services, and amplified their need for employees.  In the long run, these policies create jobs without wasting ridiculous amounts of tax dollars.  Whereas stimulus bills often create short term government dependent jobs at the cost of other potential jobs lost due to taxation.

In short, compared to their predecessors, the Republican General Assembly has most certainly valued  job creation as a primary focus.  On the other hand, Democrats and the Governor blocked additional legislation that would have further aided businesses and provided jobs.  And unfortunately, no government actions create jobs instantaneously and many, such as most of Obama’s stimulus programs, are not quite “shovel-ready.”  So perhaps critics should wait more than three months before stating that Republicans did not focus enough on jobs.

In 1788, North Carolina undoubtedly played a role in ensuring that the U.S. Constitution included a Bill of Rights.

Although the nascent United States, under the Articles of Confederation, defeated the British Empire during the American Revolution, nationalists considered the existing national government too weak and asked for a more powerful central government. In the summer of 1787, delegates from various states convened in Philadelphia. Many wanted only to revise the Articles; others wished to draft a new document and thereby institute a new form of government. After much debate, nationalists reigned supreme: the U.S. Constitution was drafted and submitted to the states for ratification (approval).

North Carolina was one of the latter states to consider the U.S. Constitution, and after much debate at the Hillsborough Convention in 1788, delegates chose neither to ratify nor reject the document. Convention delegates were divided into two groups: Federalists and Anti-Federalists. (Of the two, the former were nationalists who had taken the name Federalists, for they knew the term resonated among a populace who endorsed a federal form of government.)

The Hillsborough Convention allowed leading Federalists and Anti-Federalists to articulate constitutional arguments. Key Federalists included James Iredell Sr., who had gained widespread respect during the American Revolution for challenging Blackstone’s ideas regarding parliamentary sovereignty. Before North Carolinians convened, James Iredell Sr. had been declaring the necessity and positive elements of the document. At the convention, Iredell showcased great oratorical skill and answered many Anti-Federal questions concerning the nature of the Constitution and the threat it made regarding individual liberty. The Edenton delegate championed the document as a protector of rights because it incorporated rights into the document by limiting the central government’s power. Other key Federalists included William Blount and William Richardson Davie

Although he said little, Willie Jones (pronounced Wiley) led the Anti-Federalists; however, Samuel Spencer became their spokesman. Timothy Bloodworth was another key Anti-Federalist. These men distrusted the central government and believed states’ rights best protected individual liberties. After debating for 11 days, it became clear that the Constitution would not be ratified in North Carolina until a Bill of Rights was added. By a vote of 184 to 83, North Carolina decided not to ratify or reject the Constitution and provided a list of rights and suggested amendments for Americans.

During the latter months of 1788 and until November 1789, North Carolina was out of the Union, yet at times, the state acted as if it were in the Union. North Carolina remained out of the Union because its citizens feared the national government might encroach on individual liberties. Yet North Carolina levied a tariff on foreign goods and then turned over the profit to the United States. Meanwhile,Hugh Williamson, a delegate to the 1787 U.S. Constitutional Convention, served as an ambassador for North Carolina at Philadelphia, then the United States’ capital. There he expressed that his government acted primarily out of a concern for liberty rather than abhorrence for the new U.S. government. The United States meanwhile encouraged North Carolina to join the Union (the nation, for example, allowed North Carolina vessels to enter U.S. ports free of charge), and Williamson asked for the U.S. government to amend the Constitution in ways that might make it acceptable for North Carolinians. While Williamson garnered good will among Americans, North Carolina Federalists campaigned for another ratification convention

A second convention was held in Fayetteville. By the time it convened in November 1789, George Washington had been elected President of the United States, and almost all expected North Carolina to ratify the Constitution. A Bill of Rights had been added to the U.S. Constitution, too. North Carolina ratified the U.S. Constitution on November 21, 1789, and from the beginning, the state enjoyed the same rights as existing states.

Although it joined the Union, North Carolina remained skeptical of government power from the beginning.

    • This Week's Notes
    • Craig Horne will be at the Waxhaw Woman's Club, Thursday, October 13th at 7 PM to give a report on the Legislative Happenings in Raleigh?  It is being sponsored by the League of Women Voters and the Waxhaw Woman's Club. The Public is invited.
    • Here is website for Dixie Dreams, a potential new venue for gatherings in Union County. These pictures will give you an idea for what it's like:
    • Dan Forest Campaign Appoints Carmen Cox Ledford to Head Statewide Outreach to Homeschool Community.  Union County NC has a higher percentage of home schoolers than any county in the state, a fact that contributes to the success of its public schools having a lower cost per pupil than any other county combined with a high graduation rate.
    • Indian  Trail Town Council has scheduled a Candidate Forum on Monday October 17 at 6:30pm
    • Reminder that Paul Newby is running for NC Supreme Court.  The Justice is still needing $1300 to reach his fundraising goal. He is a critical part of maintaining the balance of the court. Please take a moment and send him a check if you can. $10 to $500 a person is what is permitted from any registered NC Voter. Let's help this great man continue to do the work of our State.
